Terms of Service

1. Introduction

Welcome to ClaimMentor, a software-as-a-service platform operated by Cordomo, Inc. ("Cordomo," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of ClaimMentor, including all related websites, applications, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or organization, you represent that you have authority to bind that entity.

2. The Service

ClaimMentor automates and streamlines recorded statements by providing tools for scheduling, recording, transcribing, and summarizing calls related to property and casualty insurance claims.

Cordomo may update or enhance features from time to time without prior notice, provided such changes do not materially reduce core functionality.

3. Eligibility

You must be at least 18 years old and legally able to enter into binding contracts. Use of the Service is limited to businesses and organizations; individual consumer use is not permitted.

4. Accounts and Access

You are responsible for maintaining the confidentiality of login credentials for your users and for all activities under your account.

You agree to notify Cordomo promptly of any unauthorized use of your account or security breach.

Cordomo reserves the right to suspend or terminate accounts that violate these Terms.

5. Subscription and Payment

Access to the Service is provided on a per-user, per-month subscription basis. Subscription fees are invoiced or billed through our designated payment processor and are non-refundable except as expressly stated herein.

Cordomo may modify pricing with at least thirty (30) days' prior notice before renewal periods.

6. Acceptable Use

You agree not to:

  • Use the Service in violation of applicable laws, including data protection or privacy laws;
  • Upload or transmit malicious code;
  • Attempt to gain unauthorized access to the Service or related systems;
  • Use the Service to record calls without obtaining required consents;
  • Resell or sublicense the Service without written consent from Cordomo.

7. Data Ownership and Processing

You retain all rights to data and content you upload or process through the Service ("Customer Data").

Cordomo may process Customer Data solely to provide and improve the Service, perform support functions, and comply with applicable law.

Cordomo implements administrative, physical, and technical safeguards consistent with SOC 2–aligned best practices to protect Customer Data.

You are responsible for ensuring that any data you provide or process complies with applicable laws (including insurance, privacy, and consent-to-record requirements).

8. Confidentiality

Each party agrees to keep confidential any proprietary or non-public information disclosed by the other in connection with the Service and to use it solely for the purposes of fulfilling its obligations under these Terms.

9. Intellectual Property

Cordomo retains all rights, title, and interest in and to the Service, including software, documentation, and trademarks.

No rights are granted to you except those expressly stated in these Terms.

10. Warranties and Disclaimers

Cordomo will use commercially reasonable efforts to make the Service available and to maintain data security.

Except as expressly stated, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

Cordomo does not guarantee that the Service will be uninterrupted or error-free.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Cordomo's total liability under these Terms shall not exceed the fees paid by you to Cordomo during the twelve (12) months preceding the claim; and
  • Cordomo shall not be liable for indirect, consequential, or special damages (including loss of profits or data).

12. Indemnification

You agree to indemnify and hold Cordomo harmless from any claims, losses, or damages arising from (a) your use of the Service in violation of these Terms, (b) your data or content, or (c) any failure to obtain required consents for recorded communications.

13. Suspension or Termination

Cordomo may suspend or terminate access if you breach these Terms or if required by law. Upon termination, your right to use the Service ceases, but sections relating to confidentiality, data ownership, limitation of liability, and indemnification survive.

14. Governing Law

These Terms are governed by and construed under the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
